Tim is a litigator and strategic legal advisor. He has a proven track record successfully litigating cases under the Magnuson-Stevens Fishery Conservation and Management Act and related laws that govern the U.S. fishing industry. \u00a0In addition to litigation, Tim frequently helps clients develop novel regulatory and legislative initiatives to solve complex problems with creative solutions. \u00a0He advises clients on the development of fishery management plans, \u00a0permitting issues, and transactions involving the sale of fishing vessels, permits, and quotas.<\/p>\n<p>Specific examples of Tim\u2019s work in the seafood industry include:<\/p>\n<ul>\n<li>Winning a lawsuit against the U.S. Department of Commerce on behalf of commercial fishing industry plaintiffs who challenged a reallocation of fishing quota;<\/li>\n<li>Representing fishing industry trade associations in defending the constitutionality of the Magnuson-Stevens Fishery Conservation and Management Act before multiple federal trial and appellate courts across the country;<\/li>\n<li>Winning lawsuit against the U.S. Department of Commerce that overturned a reallocation of fishing quota from the commercial fishing sector;<\/li>\n<li>Representing Bering Sea crab harvesters in defeating a challenge to import monitoring regulations expected to save the harvesters US$50 million per year in lost revenues due to unfair competition from illegally harvested crab;<\/li>\n<li>Representing groundfish harvesters and processors in defeating a legal challenge to Pacific whiting catch allocations;<\/li>\n<li>Winning a lawsuit against the U.S. Department of Commerce on behalf of commercial fish harvesters and processors, showing that the government violated numerous provisions of the Magnuson-Stevens Act by failing to hold the recreational fishing sector to its catch limits;<\/li>\n<li>Representing a coalition of fishing industry and environmental interests who intervened in a challenge to individual fishing quota (IFQ) and cooperative programs for the Pacific groundfish trawl fleet and succeeded in upholding the program;<\/li>\n<li>Representing fishing industry and environmental interests who intervened in a challenge to an IFQ program for grouper and tilefish in the Gulf of Mexico and succeeded in upholding the program; and<\/li>\n<li>Successfully defending a fishing company against a US$4.4 million civil penalty action brought by the U.S. Department of Commerce for allegedly exceeding crab processing restrictions.<\/li>\n<\/ul>\n<p>Before entering the legal profession, Tim worked for several years in the field of fisheries conservation.
